JAZP TERMS AND CONDITIONS

 

1. Agreement Confirmation

  1.    Applicable Terms - Please read the following terms and conditions (“Terms and Conditions”) before accessing or using the website located at https://qatar.jazp.com/qa-en/ and all associated sites linked to it (collectively referred to as the “Website”). These Terms and Conditions also apply to downloading, installing, or using Jazp’s mobile application (“Application”) or any other software provided by Jazp (“Software”). Collectively, the Website, the Application, and the Software are referred to as the “Platform.” By accessing or using any information, services, features, or resources available on the Platform via any iOS, Android, or other supported electronic device, you agree to these Terms and Conditions.
     
  2.    Jazp Trading WLL is a Limited Liability company incorporated in the State of Qatar and having CR No. 117171 (hereinafter referred to as “Jazp”). It enables Order Services (as defined below) transactions on its Platform between participating merchants and Users (as defined below). The Users can choose and place Orders (as defined below) from a variety of products and services listed and offered for sale by Partner Merchants (as defined below).
     
  3.    In respect of the above, Jazp enables Delivery Services (as defined below) as an option for Partner Merchants (as defined below). Delivery Services connect Delivery Partners (as defined below) who are responsible for providing pick-up and delivery services for Orders initiated by Partner Merchants on the Platform.
     
  4.    Jazp is not a manufacturer or distributor of the products and services listed on the Platform. It merely facilitates the placing of orders with the Partner Merchant on behalf of the User, pursuant to a contract for the sale and purchase of goods and services between the User and Partner Merchants, as governed by Law No. 22 of 2004 Promulgating the Civil Code of the State of Qatar.
     
  5.    For avoidance of doubt, it is clarified that Jazp only acts as an intermediary that facilitates transactions between Users, Partner Merchants, and/or Delivery Partners (and/or any combination thereof). It is specifically clarified that the Service Providers (as defined below) are independent contractors and are free to determine their method/manner of work. Jazp does not exercise control over the Service Providers. The relationship between Jazp and the Service Providers is not that of agent and principal, employee and employer, or partners/joint venture partners.
     

Service Availability - The availability of our Services depends on your location and the availability of the Service Providers. If you live outside the delivery area, a message will appear on your screen notifying you that ordering online is not possible. We do not accept orders from Users in areas where we do not have Service Providers. Operating hours will vary depending on local trading conditions and the availability of our Service Providers.
 

  1.        Acceptance - These Terms and Conditions constitute a legally binding agreement between Jazp and the User. By installing, downloading, or using the Platform, the User is contracting with Jazp and is deemed to have read, understood, accepted, and agreed to be bound by these Terms and Conditions. If these Terms and Conditions (or any part thereof) are not acceptable, the User must not access or use the Platform. Jazp reserves the right to suspend or terminate access to or usage of all or any part of the Platform at any time, without any liability to the User or any other person.
     
  2.        Revised Terms and Conditions - Jazp reserves the right to update, change, or replace any part of these Terms and Conditions by posting updates and/or changes to the Platform, with or without notification to the Users. Any new features or tools added to the Platform shall also be subject to these Terms and Conditions. Any new version of these Terms and Conditions shall take effect and will govern the use of the Platform and the User’s relationship with Jazp immediately upon the date of uploading the revised version on the Platform. The User’s continued usage or access to the Platform following the upload of any changes constitutes acceptance of those changes.
     
  3.        Definitions
    For the purpose of these Terms and Conditions:

“Account” shall have the meaning ascribed to it under clause 6.1 herein.

“Affiliates” shall refer to any individual, corporation, partnership, limited liability company, association, trust, unincorporated entity, or other legal entity that directly or indirectly, through one (1) or more intermediaries, controls, is controlled by, or is under common control with Jazp.

“Application” shall denote Jazp’s application and jazp.com.

“Applicable Law(s)" shall encompass all applicable laws, rules, regulations, guidelines, statutory or government notifications of the State of Qatar.

“Authorization Breach” shall signify any attempted cancellation or purported cancellation of an order by the User that constitutes a breach of the User’s unconditional and irrevocable authorization in favor of Jazp to place an order against the Partner Merchants on the User’s behalf.

“Data Protection Legislation” shall include (a) the Law of the State of Qatar; and (b) any other legislation in force from time to time relating to privacy and/or the processing of personal data applicable to the provision and receipt of services under these Terms and Conditions.

“Delivery Partners” shall denote any third-party service provider, whether an organization or an individual, partnered with Jazp for providing pick-up and Delivery Services of the Orders initiated by User(s)/Partner Merchant(s) on the Platform.

“Delivery Services” shall encompass any pick-up and delivery services provided by Delivery Partners against Orders placed by User(s)/Partner Merchants on the Platform in the State of Qatar.

“Feedback” shall represent any submission of ideas, suggestions, and/or proposals to Jazp through its suggestion, feedback, wiki, forum, or similar pages.

“Order Services” shall refer to the listed services advertised and marketed by the Partner Merchant, including but not limited to (a) consumer goods, and (b) other products and services available for Order by the User on the Platform, which the Partner Merchants may or may not accept at their absolute discretion.

“Order” shall indicate a request for Order Service placed by the User on the Platform.

“Partner Merchants” shall encompass all establishments and merchants, including but not limited to grocery stores, participating in connection with the Order Services. The term “Partner Merchant” shall apply to any one of them.

“Privacy Policy” shall denote Jazp’s privacy policy.

“Services Providers” shall refer to the Partner Merchants and the Delivery Partners.

“Jazp Material” shall include any products, images, photographs, including any person represented in the photographs, illustrations, icons, texts, video clips, music, written, and other materials owned by Jazp or its Affiliates and protected by legislation such as copyright, designs, and trademark legislation and under international treaty provisions and national laws worldwide.

“Services” shall encompass services provided by Jazp on the Platform, including Order Services and Delivery Services.

“Sensitive Information” shall denote the Customer’s private information, including but not limited to, debit card numbers and credit card numbers.

“Terms and Conditions” shall indicate these terms and conditions.

"User" or “Customer” shall refer to any person who accesses or uses the Services for the purpose of sharing, displaying, hosting, publishing, transacting, uploading information, views, and pictures, or placing orders on the Platform.
“User Content” shall have the meaning ascribed to it under clause 6.1 herein.

"We," "we," or "us" or “our” shall denote Jazp and jazp.com.

"You," "you," or “your" shall indicate a User.

  1.        Representation and Warranties
    1.    The User’s request to order products and services from a Partner Merchant by clicking on the ‘Place Order’ tab (or any other button indicating the placement of an Order) on the product page with Partner Merchant details on the Platform shall constitute an unconditional and irrevocable authorization issued by the User in favor of Jazp to place online Orders for services against the Partner Merchant and the relevant Delivery Partner, on the User’s behalf. An Order, when placed on behalf of the User by Jazp and accepted by a Partner Merchant, constitutes a separate contract of sale of goods under Law No. 22 of 2004 Promulgating the Civil Code of the State of Qatar or any successor legislation between the Partner Merchant and the User, to which Jazp is not a party.
       
    2.    The availability of the Platform to the User is solely and absolutely at the discretion of Jazp. Jazp does not guarantee that all the features available in the Application will be available on the Website, or vice versa.
    3.    By using the Services, you agree to the following:

a. You will only use the Services for lawful purposes and will not use them to send or store any unlawful material or for deceptive or fraudulent activities.

b. You will not use the Services to cause nuisance, annoyance, or inconvenience.

c. The information you provide when registering an Account or communicating with us must be accurate, and you will promptly notify us of any changes, providing reasonable proof of identity if requested.

d. You are prohibited from copying or distributing the Software or any content displayed through the Services without obtaining prior written consent from Jazp.

e. You will keep your Account password and any identification credentials provided by us secure and confidential, ensuring they are not shared.

f. You will not attempt to gain unauthorized access to any part of the Platform, service, account, resource, computer system, or network connected to any Jazp server.

g. You will not use the Platforms or Software in any manner that could damage, disable, overburden, or impair any Jazp server or the networks connected to any Jazp server.

h. You will not conduct any systematic retrieval of data or other content from the Platform, Software, or Services.

i. You will not use the Services or any accessible content for any commercial purpose, including contacting, advertising to, soliciting, or selling to any Service Provider, User, or third-party contractor, unless expressly permitted by Jazp in writing.

j. You must not create or compile, either directly or indirectly, any collection, compilation, or other directory from any content displayed through the Services, except for your personal, non-commercial use.

k. You will promptly report any errors, bugs, unauthorized access methodologies, or breaches of our intellectual property rights discovered in your use of the Platform, Software, or Services.

l. You will not misuse our promotional or credit code system by redeeming multiple coupons at once.

m. You will not deep link to or integrate with the Platform, nor access it manually or using any robot, extraction software, automated process, or device to scrape, copy, or monitor any portion of the Platform or its content unless expressly permitted by Jazp in writing.

n. You will not copy any content displayed through the Services, including but not limited to Service Providers’ catalogues and reviews, for republication in any format or media.

o. You will not try to harm other Users, Jazp, the Platform, Software, or Services in any way.

p. Please note that Jazp does not independently verify the credentials, representations, or products of merchant partners, including the ingredients and quality of any products, or whether a merchant partner adheres to relevant laws. Buyers are advised to acquaint themselves with the information provided by merchant partners on Jazp or obtain further details directly from the merchant partners to ascertain quality, reliability, and compliance with applicable laws.


 

  1.    By utilizing the Platform in any manner or undertaking any action indicating your acceptance of these Terms and Conditions (including accessing or utilizing the Platform), or completing the Account registration process, you (the User) hereby affirm and warrant the following:
  1. You have read, comprehended, and consent to be bound by these Terms and Conditions and any future amendments and additions to them as published periodically at https://jazp.com/  or through the Services;
  2. You are eighteen (18) years of age or older;
  3. You possess the legal capacity to enter into a binding agreement;
  4. You are not prohibited or legally barred from accessing or utilizing the Platform under the jurisdiction in which you reside;
  5. You possess the authority to enter into this agreement personally and, if applicable, on behalf of any company, organization, or other legal entity you have identified as the User during the Jazp account registration process, and to bind such company, organization, or entity to these Terms and Conditions;
  6. Your engagement in using the Services is for your individual, personal, or internal business use. While utilizing the Services, you agree to comply with all applicable laws from your home nation, as well as the country, state, and city in which you are present while utilizing the Services;
  7. You may access the Services solely through authorized means. You are responsible for ensuring that you download the appropriate Software for your device. Jazp bears no liability if you do not possess a compatible device or if you download an incorrect version of the Software for your device. Jazp retains the right to terminate your use of the Software and/or Services should you use the Software or Services with an incompatible or unauthorized device.

 

 

  1.        User Account
    1.    Registration -     To create an account and access certain features of the Platform, a user must provide a valid Qatar mobile number capable of receiving a One-Time Password (OTP). Verification will be completed via this OTP and will not require a password. Additionally, users must complete their profile by providing their full name, address, and email address (“User Content”). By registering, users expressly authorize Jazp to retain and utilize this information for the purpose of operating the Platform, communicating offers and marketing campaigns, facilitating the Services, and/or any other related actions. By registering, users also acknowledge and accept these Terms and Conditions. 
    1. a. OTP Confidentiality: User OTP must be kept confidential at all times and should not be shared or disclosed to anyone. You are solely responsible for all activities and orders that occur or are submitted through your account. If you suspect that someone has access to your account, please contact us immediately.
    2. b. Authorized Use: The site must not be used for any unlawful or unauthorized purposes, including but not limited to:
    3. c. Distributing any unlawful, libelous, abusive, threatening, harmful, obscene, or objectionable material.
    4. d. Transmitting material that constitutes a criminal offense, results in civil liability, or breaches any laws, regulations, or codes of practice.
    5. e. Damaging, disabling, or impairing the operation of this site or attempting to gain unauthorized access to this site or connected networks through hacking, spoofing, or similar means.


 

 

  1.    Accuracy of Information: You agree that any information/User Content you provide to us will always be true, accurate, correct, complete, and up to date. Any phone number used for registration on the Platform must be registered in your name, and supporting documents may be requested to verify this. Users understand and agree that they are responsible for the accuracy of all information provided for availing Services
  2.    Order Details Accuracy: Users warrant the details provided during order placement, such as contact number and delivery address, are accurate and correct. By providing these details, Users accept Jazp's Terms and Conditions and privacy policies.
  3.    Consent for Message Access: You agree and expressly consent that Jazp may, through automated means, access messages on your mobile device and mobile number and retrieve and utilize information from your messages to provide enhanced services from Jazp or its Affiliates.
    For example, OTP (one-time password) is retrieved from messages. By granting us access to your messages, you acknowledge that we may retrieve OTPs from messages received on your mobile device and use them for authentication.
  4.    Prohibited Conduct: Jazp shall not be responsible for damages arising from unauthorized access to users ' data. Users are prohibited from sending threatening, immoral, racially discriminatory, or unlawful messages. Harassment of other users or Jazp's personnel is strictly prohibited. Additionally, advertising, selling, or offering products or services without consent is not allowed.
  5.    Unauthorized Account Use: Users are solely responsible for all personal ideas, opinions, and statements made while using Jazp's services, uploaded files, and personal information sent. Unauthorized access or alteration of services provided by Jazp is prohibited. Users agree to indemnify Jazp for any losses resulting from non-compliance.
  6.    Account Suspension or Termination: We reserve the right to suspend or terminate your Account and access to Services if:
  1. Any User Content provided during registration or thereafter is found to be inaccurate, outdated, or incomplete;
  2. Your actions may cause legal liability for you, other Users, or us; and/or
  3. Non-compliance with these Terms and Conditions is observed.
  1.    User Responsibility for Data: Users are solely responsible for any damages or losses caused by their actions on their devices while using Jazp's services. No compensation can be demanded for losses arising from service use. Commercial and advertising use of Jazp's services without consent is prohibited.

 

  1.        Use of the Platform
    1.    Services
      Through the Platform, Jazp provides a portal for ordering products or services from Partner Merchants. Users can access the Order Services of Partner Merchants listed on the Platform and place orders, which the Partner Merchants may accept or reject at their absolute discretion.

 

  1.    Orders
    When you place an order through our Platform, you will receive a confirmation SMS on your registered mobile number. If you provided an email address during account registration, a confirmation email ("Confirmation Email") will also be sent to you from Jazp on behalf of the Partner Merchant, confirming that your order has been received and accepted by the Partner Merchant. The contract for the supply of any (a) consumer goods, and (b) other products and services will be between you and the Partner Merchant and will only be formed when we have sent you the Confirmation Email Or SMS. Ensure you provide the correct email address, accurate address, and telephone number to facilitate successful delivery. If you do not respond within 5 minutes of our Delivery Partner/Partner Merchant reaching your address, we reserve the right to leave.
    Jazp is committed to providing the best possible experience. If there is an issue with your order (e.g., missing items, product quality issues, delays), please contact our Customer Support Centre. Refer to our cancellation policy if you wish to cancel your order. All items are subject to availability
     

7.3 Product Availability

a. Stock Availability: All products are subject to stock availability at the time of order in Qatar. Please proceed to checkout and place your order.

b. Order Confirmation: Our team will promptly verify the physical stock and provide order confirmation within 2-4 working hours.

c. Payment Processing: Your online card payment will not be processed unless product availability is confirmed. You only pay for what is available

  1.    Delivery Period
    Delivery periods and pickup times quoted at the time of ordering are approximate and may vary.
     
  2.    Delivery Address Accuracy
    We will make every effort to deliver your order to the address provided during the ordering process. Ensure that the given address (Area, Zone, Street, Building) details are accurate. If you need to change the delivery location, inform us before the driver is dispatched. The new address must be within the same delivery zone as the original. If the delivery process has already begun, address changes may not be possible. You may cancel the order and place a new order.
  3.    Failed Delivery
    You order will be kept on hold or cancelled if the delivery fails due to your actions. Instances of delivery failure include:
  1. Unavailability at the provided address.
  2. Failure to answer the phone when the driver contacts you.
  3. Inability to provide access to the delivery location in a reasonable time.

  1.    User Content
    Jazp may provide interactive opportunities, such as posting User ratings and reviews. You represent and warrant that you own or have the right to provide all User Content you submit. You grant Jazp a perpetual, irrevocable, transferable, fully paid, royalty-free, non-exclusive, worldwide, fully-sublicensable license to use, copy, display, publish, modify, remove, publicly perform, translate, create derivative works, distribute, and otherwise use the User Content in connection with Jazp’s business. You also grant Jazp the right to use your username and profile information to attribute User Content to you.
     
  2.    Feedback
    Submitting ideas, suggestions, or proposals ("Feedback") to Jazp is at your own risk. Jazp has no obligations regarding such Feedback. You represent and warrant that you have the necessary rights to submit Feedback and grant Jazp a perpetual, irrevocable, transferable, fully paid, royalty-free, non-exclusive, worldwide, fully-sublicensable license to use, copy, display, publish, modify, remove, publicly perform, translate, create derivative works, distribute, and otherwise use such Feedback.
     
  3.    Ratings and Reviews
    Ratings and reviews are considered User Content and are governed by these Terms and Conditions. They are not endorsed by Jazp and do not represent Jazp’s views. Jazp does not assume liability for Ratings and Reviews. To maintain integrity, you agree that:
  1. You will base any Rating or Review on first-hand experience.
  2. You will not provide a Rating or Review for businesses with which you have an affiliation or for their competitors.
  3. You will not submit a Rating or Review in exchange for payment or benefits.
  4. Your review will comply with these Terms and Conditions. Jazp may exclude User Content that diminishes the integrity of Ratings and Reviews.
  5. Ratings and reviews submitted by users may be shared with third-party service providers for analysis, marketing, or promotional purposes.
     
    1.    Acceptable Content
      While we encourage user reviews, Jazp reserves the right to reject reviews at our discretion. Reviews may be rejected for:
  1. Offensive Language: Profanity, abusive language, racism, or hate speech.
  2. Irrelevant Content: Reviews must focus on relevant experiences.
  3. Discrimination: Reviews must not discriminate based on religion, race, gender, national origin, age, marital status, or disability.
  4. References to Illegal Activity: Reviews referencing illegal activities or violating societal values.
  5. Conflicts of Interest: Competitors posting negative reviews.
  6. Outdated Information: Reviews should reflect current experiences.
     
    1.                   Not Endorsed
      Reviews on our platform are not endorsed by Jazp and do not represent our views. Jazp does not assume liability for reviews or claims resulting from platform use.
      Ownership of Reviews: All reviews become Jazp's property indefinitely. We may reproduce, modify, translate, transmit, and distribute review materials. Jazp is not obligated to compensate authors for reviews.

 

8. Payment

8.1. Payment Method

We accept online payments through third parties, including Visa, MasterCard, Jazp Wallet, Apple Pay, Google Pay, and Amex. By placing an order, you warrant that:

  1.     All payment information provided is true and accurate.
  2.     The account used for payment has sufficient funds to cover the transaction and is active.
  3.      You are the holder or authorized user of the account, and you authorize the full transaction amount to be charged.
  4.     We reserve the right to add or remove any payment options at any time without prior notice.

 

8.2. Payment Processing

All payment processing for purchases on the Platform may be handled through third-party e-commerce vendors. If paying by credit card, a standard pre-authorization check may be performed to ensure sufficient funds. If payment is refused, you will be notified immediately. Payment may be declined if:

  1. Billing information does not match bank records.
  2. The card has expired or been canceled.
  3. Fraud or security issues are detected.
  4. Any other technical error

8.3. Prices
You understand that:

  1. All commercial/contractual terms are agreed upon solely between the User and the Service Providers for the products and Services they offer. These terms include, but are not limited to, price, applicable taxes, delivery fees, payment terms, delivery dates, warranties, and after-sales services. Jazp does not control or influence these terms. However, Jazp may offer support services to the Service Providers, including order fulfillment, payment processing, payment collection, call center support, and other ancillary services under independent contracts with the Service Providers. The prices of products and Services offered by Partner Merchants are determined solely by the Partner Merchants, with no input from Jazp.
  2. Jazp ensures that all listed prices are accurate at the time of publication, as provided by the Partner Merchants. The total price for ordered products and/or Services, including delivery and other charges, will be displayed on the Platform when you place your order.
  3. The prices for catalogue items displayed through the Services may differ from those offered or published by Partner Merchants for the same items and/or from prices available on other third-party websites. These prices may not be the lowest available.
  4. Jazp is not obligated to itemize its costs, profits, or margins when publishing prices.
  5. Jazp reserves the right to change prices at any time at its discretion. You are liable for all transaction taxes on the Services provided under these Terms and Conditions, except for taxes based on Jazp’s income. Payment will be processed using the preferred payment method designated in your account.
  6. Both Jazp and Merchant partners reserve the right to add a delivery fee to each order ("Delivery Charge"), based on the location, price, and size of the item, which will be presented at checkout.

8.4. Promotional Offers
Jazp and/or Partner Merchants may, at their discretion, offer promotional deals with different features and rates to any Users. These offers, unless made to you, have no bearing on your offer or contract. The fulfillment and validity of these offers depend on the Service Providers, payment partners, and third parties. Jazp takes no responsibility for such offers.
 

8.5. Fees for Services and Software
Jazp may charge service fees as necessary or appropriate.

8.6. Successful Checkout

Upon successful checkout, your credit card or account will be charged the full transaction amount. "Successful Checkout" means:

  1.       You confirm and submit your transaction.
  2.       We accept your transaction.
  3.        A pre-authorization checks on your card are completed.
  4.       Your bank or account has not declined the transaction.
  5.       Jazp reserves the right to offer or discontinue payment methods.
  6.         Users are responsible for having sufficient funds or using credit cards within the limit.
  7.        If Cash on Delivery (COD) is available, it will be indicated on the Application. Only cash payments are accepted for COD orders. For COD, drivers may carry limited change, so prepare the exact payment if possible.
  8.       Partner Merchants may offer special deals through the Application, subject to withdrawal at any time unless an order based on the offer has been placed and confirmed.

 

8.7. Modification and Cancellation of Order

Order modifications will be accepted only if the Partner Merchant agrees. Users may cancel orders if:

  1.     Failure to contact your phone or email.
  2.     Unavailability of products and services.
  3.      Incorrect details provided.
  4.     Wrong order delivered.
  5.     Damaged products or tampered packaging.
  6.      Missing items from the order.
  7.     Even after an order has been confirmed, it may still be subject to cancellation due to technical issues, discrepancies between system stock and warehouse stock, or non-deliverable conditions.

8.8. Customer Unreachable

If the Delivery Partner arrives on time but cannot reach the User within five minutes, the order will be deemed delivered and returned to the Partner Merchant.

 

9. THIRD-PARTY SERVICE PROVIDERS

9.1 Suitability and Legality

Jazp.com does not assess the suitability, legality, or ability of any third-party provider. Jazp.com holds no responsibility or liability for acts of any third-party service providers beyond what is stated herein.

9.2 Payment Information

You may need to provide your sensitive information to approved payment gateways when making a payment. By doing so, you agree to provide accurate card details to these payment gateways for the services availed. Your information will not be used or shared with any third party except for fraud verification or as required by law. You are solely responsible for the security and confidentiality of your card details. We expressly disclaim all liabilities arising from unauthorized use of your card.

9.3 Financial Transactions

The platform is not equipped or authorized to complete financial transactions. All payments are processed through the payment gateway, with Jazp.com conducting these payments to the partner merchant. The payment receipt will be issued directly by the partner merchant, and you should request an invoice from them.

9.4 No Endorsement

We do not endorse any third-party service provider. Despite the requirement to provide accurate information, we do not confirm or verify the identity of any third-party service provider

9.5 Limitation of Liability

You agree not to attempt to impose liability on or seek any legal remedy from us for any actions or omissions of third-party service providers.

9.6 Acknowledgment of Third-Party Services

You acknowledge and agree that Jazp.com facilitates the hosting of products and services offered by third-party providers. Jazp.com does not:

(a) Provide any warranties, whether express or implied, regarding the quality of the products and services offered by these third-party providers;

(b) Endorse or confirm that the products and services provided by these third-party providers meet any specific quality standards or have been rated in a particular way;

(c) Assume any liability if the products and services provided by these third-party providers do not meet user expectations, or if users suffer any loss, damage, or injury as a consequence of using such products and services;

(d) Assume any liability for any changes, alterations, amendments, or replacements to the products and services offered by third-party providers.

(e) A valid user ID must be presented at the time of delivery

 

 

10. THIRD-PARTY WEBSITES, APPLICATIONS, AND ADVERTISEMENTS

10.1 The services provided by Jazp.com may include links to external websites (“Third-Party Websites”), applications (“Third-Party Applications”), and advertisements (“Third-Party Advertisements”) collectively referred to as “Third-Party Websites & Advertisements”. The User agrees that Jazp.com shall not be liable in any manner if the User is unable to avail of the offer(s) with a Service Provider due to the Service Provider’s violation of any statutory rule, regulation, or license.

The visual interfaces, graphics, design, compilation, information, system code (including source code and object code), products, software, services, and all other elements of this Platform provided by Jazp.com are protected by Qatari copyright, patent, and trademark laws, international conventions, and all other relevant intellectual property and proprietary rights and applicable laws.

 

13.2 As between you and Jazp.com, all Jazp.com Materials, trademarks, service marks, and trade names contained on the Platform are the property of Jazp. You agree not to remove, obscure, or alter Jazp’s or any third party’s copyright, patent, trademark, or other proprietary rights notices affixed to or contained within or accessed in conjunction with or through this Platform. Except as expressly authorized by Jazp, you agree not to sell, license, distribute, copy, modify, publicly perform or display, transmit, publish, edit, adapt, create derivative works from, or otherwise make unauthorized use of the Jazp Materials.

You agree to indemnify, save, and hold Jazp.com, its Affiliates, employees, officers, directors, and partners harmless from any and all claims, losses, damages, liabilities, costs, and expenses, including without limitation legal fees and expenses, arising out of or related to (a) your use or misuse of the Platform; (b) any violation by you of these Terms and Conditions or any other policies applicable to your use of the Platform; or (c) any breach of the representations, warranties, and covenants made by you herein. Jazp reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify Jazp, including the right to settle, and you agree to cooperate with Jazp’s defense and settlement of these claims. Jazp will use reasonable efforts to notify you of any claim, action, or proceeding brought by a third party that is subject to the foregoing indemnification upon becoming aware of it. This paragraph shall survive termination of these Terms and Conditions.

 

15. Privacy and Communications

15.1 Privacy Policy: Our information collection practices on the Platform, such as the types of information we collect regarding visitors to the Platform and the ways in which we may use that information, are governed by the terms of our Privacy Policy.

 

15.2 Transfer of Data: Jazp may share your payment-related information with banks, third-party providers, and service providers required for operations, settlement, payment processing, and promoting Services.

 

15.3 Data Protection: Jazp offers the use of a secure server for the transactions conducted by Customers on the Platform. All supplied Sensitive Information is transmitted and encrypted into our payment gateway provider's database. Such information is only accessible by those authorized with special access rights to such systems and is kept confidential. Sensitive Information shall not be stored on our servers, and the usage of the same shall be in compliance with the Data Protection Legislation.

 

15.4 Your Submissions and Unsolicited Communications: This section concerns communications sent to Jazp. It does not concern the communication of personal information to Jazp in relation to customer inquiries or the use of Services through the Platform. Any unsolicited communication or material that you transmit to Jazp via the Platform by electronic mail or otherwise, including but not limited to any data, questions or answers, comments, suggestions, or the like, will be treated as non-confidential and non-proprietary by Jazp. By sending communications to Jazp, you automatically grant Jazp a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, modify, publish, edit, translate, distribute, perform, and display such communication(s) alone or as part of other works in any form, media, or technology, whether now known or hereafter developed, and to sublicense such rights to anyone. Anything that you transmit may be used by Jazp and its affiliated companies for any purpose, including but not limited to reproduction, disclosure, transmission, publication, broadcast, and posting or developing, manufacturing, and marketing products using such information.

 

16. Limitations of Liability

16.1 In no event shall Jazp or its Affiliates, contractors, agents, licensors, partners, or suppliers be liable to you for any special, indirect, incidental, consequential, punitive, reliance, or exemplary damages arising out of or relating to: (a) these Terms and Conditions and its other policies applicable to you; (b) the Services, the Platform; or (c) your use or inability to use the Platform, even if Jazp or a Jazp authorized representative has been advised of the possibility of such damages. In such cases, Jazp’s liability will be limited to the fullest extent permitted by applicable law. This paragraph shall survive the termination of these Terms and Conditions.

 

16.2 Jazp shall not be liable for any actions or omissions by the Service Providers, including deficiency in service, wrong delivery or order, quality of goods, time taken to prepare or deliver the order, etc.

 

16.3 Further, we will not be responsible for any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill, or wasted expenditure) or any other indirect or consequential loss that is not reasonably foreseeable to both you and us when you commenced using the Platform.

 

 

16.4 Jazp shall in no manner be liable in any way for any in-person interactions with representatives or staff of the Partner Merchant or for the User’s experience at the Partner Merchant’s outlet. Jazp is not liable to the User if any outlet of Partner Merchant temporarily or permanently shuts down its operations. Jazp will only take care of claims/liabilities arising out of offers/membership plans advertised by Jazp solely.

 

16.5 We expressly disclaim all liabilities that may arise as a consequence of any unauthorized use of credit/debit cards.

 

16.6 You acknowledge that third-party services are available on the Platform. We may have formed partnerships or alliances with some of these third parties from time to time to facilitate the provision of certain services to you. However, you acknowledge and agree that at no time are we making any representation or warranty regarding any third party's services, nor will we be liable to you or any third party for any consequences or claims arising from or in connection with such third party including, and not limited to, any liability or responsibility for, death, injury, or impairment experienced by you or any third party. You hereby disclaim and waive any rights and claims you may have against us with respect to third parties’ services.

 

16.7 The list of products and Services offered on the Platform is provided "as is". We and/or our employees make no warranty or representation regarding the quality, timeliness, content, packaging, efficiency in service, wrong delivery of order, delay in reaching the order, order package tampering, etc.

 

16.8 In no event shall we be liable for any damages, including but not limited to direct, indirect, incidental, special, consequential, or exemplary damages, damages arising from personal injury or wrongful death, or damages resulting from lost profits, lost data, or business interruption, arising from any services provided by any Service Provider through the Platform. This applies regardless of whether the claim is based on warranty, contract, tort (including negligence), or any other legal theory, and regardless of whether we are advised of the possibility of such damages. However, at our sole discretion, we may attempt to refund any amount paid by the User. Our liability, if any, in this regard will be strictly limited to the amount paid by the User with respect to the said order on the Platform.

 

16.9 Jazp tries to ensure that the information provided is accurate and complete; however, it does not warrant that the content of this Platform is accurate, complete, reliable, current, or error-free.

16.10 Jazp does not warrant that the functional and/or technical aspects of the Platform or the Jazp Material will be error-free or that Jazp, Jazp Material, or the servers that make them available are free of viruses or other harmful components. If the use of the Platform or Jazp Material results in the need for servicing or replacing property, material, equipment, data, or other elements, Jazp is not responsible for those costs. Without limiting the foregoing, everything on the Platform is provided to you "as is" and "as available" and, to the fullest extent permitted by applicable law, without warranty of any kind, either expressed or implied, including, but not limited to, the implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, reasonable care and skill, or non-infringement. Jazp and its suppliers make no warranties about the Jazp Material, software, text, downloads, graphics, and links, or about results to be obtained from using the Platform.
 

16.11 To the fullest extent permitted by applicable law, Jazp shall not be liable for any indirect, incidental, special, or consequential damages of any kind arising out of or in connection with the use of information available from the Platform or any liability relating to any loss of use, interruption of business, lost profits, or lost data, regardless of the form of action, whether in contract, tort, or otherwise, even if Jazp has been advised of the possibility of such damages.

 

17. FORCE MAJEURE CLAUSE

If performance under these Terms and Conditions by Jazp is prevented, restricted, delayed, or interfered with by reason of labor disputes, strikes, acts of God, floods, lightning, severe weather, shortages of materials, rationing, government-imposed lockdowns, pandemics, inducement of any virus, Trojan or other disruptive mechanisms, any event of hacking or illegal usage of the platform, utility or communication failures, earthquakes, war, revolution, acts of terrorism, civil commotion, acts of public enemies, blockade, embargo, or any law, order, proclamation, regulation, ordinance, demand, or requirement having legal effect of any government or any judicial authority or representative of any such government, or any other act whatsoever, whether similar or dissimilar to those referred to in this clause, which are beyond the reasonable control of Jazp and could not have been prevented by reasonable precautions, then Jazp shall be excused and discharged from such performance to the extent of and during the period of such force majeure event, and such non-performance shall, in no manner whatsoever, amount to a breach by Jazp of its obligations herein.

 

18. TERMINATION AND SUSPENSION

These Terms and Conditions shall continue in effect until termination and may be terminated by the User at any time when the User has no liabilities held by or owed to Jazp. Upon the actual receipt by Jazp of any written notice of termination via registered e-mail or other means, such termination shall not affect any transactions previously entered into and shall not relieve either party of any obligations set out in these Terms and Conditions, nor shall it relieve the User of any obligations arising out of prior transactions entered into in connection with these Terms and Conditions.

Failure to comply with (Acceptable Use Terms) and/or (Content Standards) in these Terms of Use constitutes a material breach of the Terms of Use, and may result in our taking all or any of the following actions:

Immediate, temporary, or permanent withdrawal of your right to use our Service;

Immediate, temporary, or permanent removal of any posting or material uploaded by you to our Service;

Issuing of a warning to you;

Legal action against you including proceedings for reimbursement of all costs (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;

Disclosure of such information to law enforcement authorities as we reasonably feel is necessary.

The responses described in this clause are not limited, and we may take any other action we reasonably deem appropriate.

 

19. JURISDICTION & GOVERNING LAW

To the fullest extent permitted by applicable law, Jazp hereby disclaims all representations and warranties, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, non-infringement, freedom from computer virus, and any implied warranties arising from the course of dealing or course of performance.

21.2 Scope of License:

Jazp grants you a non-exclusive, non-transferable, non-assignable, non-sub-licensable, irrevocable license solely for your personal use in accordance with this agreement. Therefore, you must:

Non-Sharing with Third Parties: Not make the services available, rent, lease, sub-license, re-sell, distribute, or internally license these services to any third party.

Prohibition Against Modification or Reverse Engineering: Not modify, bypass, translate, summarize, create derivative works based on, reverse engineer, or attempt to discover the source code or internal design of the Jazp platform or any text, media, data, or other information provided by Jazp or third-party service providers.

Respect Copyright and Official Notices: Not delete, alter, or otherwise modify any copyright or other official notices within the services.

Prohibition on Unauthorized Transfer: Not deliberately transfer or distribute the services or allow the download of the services for use other than as specified here.

Maintain Confidentiality of Access Credentials: Do not share your username/password or any other access credentials to access Jazp services.

21.3 Restricted Materials:

As part of Jazp's policy, users and drivers are prohibited from purchasing, delivering, sending, receiving, or handling the following categories of materials and products:

Alcohol and spirits

Prohibited animals and species

Pornographic materials

Copyrighted and intellectual property items

Counterfeit and unlawful goods

Devices used for bypassing or hacking technological protection

Drugs and drug-related equipment

Games and gambling

Electronic piracy materials

Human organs

Illegal and stolen goods

Illegal telecommunication equipment

Supernatural remedies

Inappropriate goods

Aggressive and criminal goods

21. Payment Terms and Pricing:

Jazp reserves the right to impose new fees on the use of the platform or service. You are required to pay for the service immediately upon receiving the service.

The delivery service price is determined by distance, and users have the right to review and accept the price before starting the service.

 

21.5 Legal Liability and Liability Limitation:

Jazp provides information, recommendations, and services for general purposes only and does not constitute advice.

Jazp is not liable for any damages resulting from using the website, platform, or service, including damages caused by harmful software or viruses. The responsibility for the quality of services lies with the service provider, and Jazp is not responsible for any actions, behavior, or negligence of the delivery partner. Jazp does not provide any express or implied warranties concerning the services. Jazp, its agents, licensors, and affiliates will not be liable for direct or indirect damages resulting from accessing and using the services or relying on them.

22. CANCELLATION POLICY

22.1. You can cancel your order at any time before or after it is accepted by the Partner Merchant. To cancel, click "CANCEL ORDER" on the Platform before acceptance. If the order has been accepted, contact Jazp Customer Support with a brief reason for cancellation. If approved, a full refund will be issued promptly

22.2. Refunds will be processed through the same method as the original payment unless refunded to the User’s Wallet, which reflects within 24 hours of cancellation. If refunded to a credit card, debit card, or Apple Pay, Jazp will initiate the refund promptly, typically appearing in your account within 3 to 7 business days, subject to your bank's processing time.

 

22.3. It's important to note that if any portion of the order was paid using the wallet, the User cannot request a transfer of this amount to their credit card or bank account. Instead, the refunded amount will be credited back to the wallet.

 

 

23. ITEM NOT FOUND OR PARTIAL CANCELLATION

 

23.1. If you receive an order with a missing item, you have the right to request a new item or a refund under the following circumstances:

(a) Upon notification by Jazp Customer Support that an item is missing from your order; or

(b) If you discover a missing item notify Jazp Customer Support, and they verify and accept your notification.

 

23.2. In such cases, you can choose to either replace the product or request a refund.

 

24. RETURN POLICY

All complaints, concerns, or other issues with a Product shall be forwarded to the Partner Merchant. The Partner Merchant shall be solely responsible for dealing with all such complaints, concerns, and other issues from a User on the same basis as if it had sold the Product directly to the User. Jazp shall have no responsibility in this regard
 

24.1. HOW TO INITIATE AN EXCHANGE OR RETURN?

24.1.1. To initiate an exchange or return, the customer should submit a Return/Replacement Complaint registration through the official website of Jazp.com. While registering the complaint, the user should specifically mention the issue/complaint with a short description, and images of the product/package should be attached.

24.1.2. Subject to the terms outlined in this Return Policy, non-perishable items may be returned or exchanged within 7 days of the original purchase date. Orders outside this 7-day window are not eligible for exchange or return.

 

24.2. ELIGIBILITY FOR RETURN

24.2.1. Before filing your complaint, please ensure your item meets these return guidelines:

(a) Items must be unopened.

(b) Items must be returned in perfect condition, with original product packaging and all tags attached.

(c) Items must show no visible signs of wear or use.

(d) For hygiene and safety reasons, the following items are non-refundable and non-exchangeable:

  • Hair Accessories

  • Candles, Oud, Incense, or any of its derivatives

(e) Perishable items such as milk, fruits, vegetables, etc.

(f) Products sold as sets (purchases consisting of several items sold together) cannot be exchanged or refunded individually.

(g) Games (Software), Subscription Cards, Gift Cards, and Digital products cannot be exchanged or refunded. Digital codes & cards (iTunes, Xbox, PlayStation, Spotify, etc. gift cards) once ordered, cannot be exchanged or refunded.

24.2.2. Jazp or Partner merchants do not accept returns for items that are damaged, defective, or significantly different from what was delivered. Upon initiating a return request, the merchant will open an investigation. Once they approve your return request, jazp will proceed with processing the return and refund. Refunds will be processed as per the following timeline:

Refund Timeline:

Wallet: 24 hours

Bank account (QNB to QNB): 48 hours

Bank account (QNB to Non-QNB): 3-10 working days

Debit / Credit Card: 3-10 working days


 

24.2.3. Products purchased under promotional prices will be refunded based on the promotional purchase price.

 

 

24.2.4. Beauty and Healthcare Products

All beauty and healthcare products ordered from Jazp can be returned within 7 days from the date of delivery.

24.2.4.1 Non-Eligibility for Return: Healthcare products cannot be returned under the following circumstances:

(a) If the item has been opened, partially used, or damaged.

(b) If the product has water damage or has been improperly stored.

(c) If the product packaging, box, or seal has been tampered with.

(d) If it is stated on the product detail page that the item is non-returnable.

(e) If any accessories or freebies included with the product are missing.

(f) If the product lacks a serial number, UPC, or barcode affixed at the time of delivery acceptance from the delivery agent.

(g) If the damage or defect is not covered under the manufacturer's warranty.

(h) If the product is missing its original packaging and accessories/freebies.

(i) If the product has been damaged due to misuse.

24.2.4.2 The decision to accept a return for beauty and healthcare products rests with the Partner Merchant's professional judgment. It is recommended to thoroughly inspect the delivery package before accepting it from the delivery agent.

24.2.4.3 Products related to personal care, baby care, food & nutrition, healthcare devices, COVID essential products (e.g., masks, gloves), sexual wellness products (e.g., condoms, pregnancy/fertility kits), and other items (e.g., diapers, health drinks, supplements, glucometers, health monitors) are generally non-returnable. However, these products may be eligible for return if found defective, deficient, spurious, or not as advertised, or if they are delivered late.

24.2.5. Flowers and Balloons

The following items cannot be returned:

(a) Flowers: Due to their perishable nature, returns or exchanges for flowers are not accepted.

(b) Balloons: Due to their delicate nature, returns or exchanges for balloon products are generally not accepted. However, balloons may be eligible for return or exchange if the request is made within 30 minutes of placing the order.

24.2.6. Electronics

24.2.6.1 Eligibility for Return:

(b) To qualify for a return, the item must be in its original condition, including all packaging materials, manuals, and accessories.

(c) Returns are not accepted for items that have been damaged, altered, or tampered with after delivery.

(d) If the product has been used or products original box was opened or seal were removed, the product replacement and refund will not be processed, unless there is a manufacturing defect or there is a physical damage upon delivery, provided it is reported within 24 hours of delivery.

24.2.6.2. Return Period:

(a) You may initiate a return within 7 days from the date of delivery.

(b) Items returned after 7 days will be considered final sale and ineligible for return.

24.2.6.3. Return Process:

(a) For after-sales needs, such as repairs, maintenance, or warranty claims, customers should contact the Partner Merchant's Store or authorized service center directly.

(b) While we can assist by providing information and facilitating contact with the relevant service center, we are not obligated to collect items for return once delivery is completed.

(c) Users are responsible for following the return process and guidelines provided by the Partner Merchant's Store or authorized Service Center.

 

24.2.6.4. Product Warranty:

(a) Warranty coverage for electronics is provided by the Partner Merchant or manufacturer, as specified in the product description or documentation.

(b) Customers should refer to the warranty terms and conditions provided by the Partner Merchant or manufacturer for details on coverage, duration, and any limitations or exclusions that may apply.

 

24.2.6.5. Our Support:

(a) We will endeavor to assist you in connecting with the Partner Merchant's Store or authorized service center for after-sales support.

(b)Additionally, the user will have the option to contact, chat, or message the Partner Merchant through our application and website.

(c) We will provide relevant contact information and facilitate communication between you and the Partner Merchant/Service Center to address concerns or warranty claims.

(d) Please note, our role is to provide information and facilitate communication for after-sales requirements. Specific terms and conditions for repairs, maintenance, or warranty claims are governed by the Partner Merchant or manufacturer.

 

25. ACCEPTABLE REASON FOR ITEM RETURNS

25.1. Jazp does not guarantee the quality of products delivered by third-party merchants. If you suspect a manufacturing defect with your item, please contact us promptly for assistance. To be eligible for a return, the item must fall into one of the following categories:

(a) The item delivered has a manufacturing defect caused by an error on the merchant’s end, such as in material, design, or workmanship.

(b) The delivered item is damaged (physically destroyed or broken) or defective (e.g., unable to function properly).

(c) The delivered item is incomplete (missing items or accessories).

(d) The delivered item is incorrect (wrong product, size, color, counterfeit, or expired).

(e) The delivered item does not match the product description or image (not as advertised).

(f) The delivered item does not fit (size unsuitable).

25.2.  Decisions regarding returns are at the sole discretion of Partner Merchant and Jazp and in accordance with our internal policies, which are final and binding.

25.3. Jazp reserves the right to suspend or terminate any refund immediately, without prior notice, if the refund violates the terms of this Return Policy or in cases of:

(a) Suspicious activity.
